Probate occurs in the Court’s Probate Department. Documents filed with the Court’s Probate Department are public records. The Court supervises and settles disputes concerning every step of the process. Court Probate Fees for the Personal Representative of the deceased and the Attorney are set by the Court based on the value of the gross probate estate. The Court can increase probate fees for so-called extraordinary services. Probate fees are generally significantly higher than Trust Administration Fees, and the Probate process is generally longer than Trust Administration.
